Agreement to Terms

By accessing or using Played ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Played is a mobile application that allows you to track, analyze, and visualize your music listening history. The Service enables you to upload your Spotify listening history data and provides insights, statistics, and personalized information about your music listening habits.

User Accounts

Account Creation

• You must create an account to use certain features of the Service
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate, current, and complete information during registration
• You are responsible for all activities that occur under your account

Account Security

• You must immediately notify us of any unauthorized use of your account
• We are not liable for any loss or damage arising from your failure to protect your account credentials

User Responsibilities

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Infringe upon the rights of others
• Upload malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to the Service or related systems
• Use the Service to transmit spam or unsolicited communications
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems to access the Service without permission

Data Upload

• You represent and warrant that you have the right to upload any listening history data you provide
• You grant us a license to use, store, and process your uploaded data to provide the Service
• You are responsible for ensuring your data does not violate any third-party rights

Third-Party Services

The Service integrates with Spotify and other third-party services. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

Intellectual Property

The Service and its original content, features, and functionality are owned by Played and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to defend, indemnify, and hold harmless Played and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.
